We have also employed a full service law firm to help with any necessary litigation. Our attorneys are more than capable to handle any legal needs that might arise throughout the recovery process. AMS will provide you with recovery consulting and counsel throughout our contract.

Our clients are released and indemnified from any and all liability from the actions of AMS, our employees, staff, officers and agents. AMS will defend and hold harmless our clients against any losses, up to one million dollars in claims, demands, damages, suits or actions of whatever type or nature. AMS uses our best efforts to collect delinquent debt for our clients.

  • If a delinquent debtor ever files for bankruptcy during any part of the recovery process AMS has established procedures for the delicate handling of such situations.
  • AMS will zero out our system and put a note on file to be certain no letters or calls are made to the defendant during the pending bankruptcy
  • AMS will file an unsecured creditor claim with the bankruptcy trustee.
  • AMS will file a motion to be exempt from the bankruptcy. According to Bankruptcy code, court fines and criminal matters are exempt from those debts and obligations that can be released in bankruptcy.
  • As soon as our motion to be exempt from the bankruptcy is approved by the court we will proceed with our recovery efforts.

Fair Debt Collections Practices Act (FDCPA)

Disputes regarding our clients and their debtors are always handled in compliance to the Fair Debt Collection Practices Act.

AMS has policies and procedures in place regarding how our collection agents handle verbal communication with debtors. All phone conversations are monitored or recorded to assure quality performance and see that proper collection techniques are always followed. Each of our collection agents are highly trained and under supervision. They understand to whom they may speak with involving confidential information.

If anyone other than the debtor or spouse requires information on the case, it is only given with the written consent of the debtor. Only the utmost of respect is used while dealing with debtors. All personal information will be shredded if and when it becomes obsolete.
